The following principles have been crafted to maintain the highest service standards. Service agreement

The Medisoma.lts Service Agreement represents an independent agreement between Vivihosting.com and all our customers. Prior to signing up for or using Vivihosting.com services, please ensure that you concur with the following terms and conditions, as well as our comprehensive service agreement.

Resource usage policy

The Vivihosting.com Resource Usage Policy serves as an expansion of our Terms of Service, encompassing more detailed guidelines on resource utilization. Prior to signing up for or using Vivihosting.com services, please ensure that you concur with its terms and conditions.

Domain

The Vivihosting.com Domain Registration Agreement is relevant to all domains registered by a client or transferred to Vivihosting.com. When a client registers or transfers a domain, it implies their acknowledgment and acceptance of the terms set forth in the Domain Registration Agreement.

Content

All services offered by Vivihosting.com must be used exclusively for legal purposes. The transmission, storage, or display of any information, data, or material that contravenes any law is strictly prohibited. This encompasses, but is not limited to, copyrighted material, content deemed as threatening or obscene, and material safeguarded by trade secret or other legal statutes. By subscribing, the user commits to indemnify and absolve Vivihosting.com from any claims arising due to the utilization of the service that causes harm to the subscriber or any other party.

Please be aware that the hosting of pornography and the promotion of sex-related merchandise are strictly forbidden on all Vivihosting.com servers. This prohibition extends to websites that imply sexual content or link to adult content hosted elsewhere. Additionally, this restriction applies to websites that endorse any form of illegal activity or content that could potentially harm Vivihosting.com servers or any other servers on the Internet. Including links to such materials is also prohibited.

Examples of non-acceptable content

• Violation of a copyright or any other right of any third party;
• Materials or Links to movies, TV channels, mp3 or other media formats;
• Promotion of illegal activities (hacking, cracking, warez, etc.);
• Materials protected by trade secrets or any other status;
• Threats, abuse, harassment, slanderous statements;
• Materials intended to encourage feelings of hatred or discrimination;
• Adult content, nudity, pornography, any image or text with sexual or obscene content;
• Information or software about or containing any type of viruses or Trojans;
• Collection of personal information for use for illegal purposes;
• Personal data without the written consent of the persons concerned;
• Any content deemed by us to be harmful or illegal.

Vivihosting.com retains the exclusive authority to determine what qualifies as a breach of this regulation and maintains the prerogative to deactivate and delete any website at its discretion, for any reason, at any given time.

Copyright

Vivihosting.com commits to addressing all reports of copyright infringement that adhere to the provisions outlined in the Digital Millennium Copyright Act and any other relevant copyright laws. Reports of infringement that do not conform to the DMCA will not be reviewed. Our approach to handling infringement reports aligns with the DMCA guidelines.

Resources

If Vivihosting.com system administration team concludes that an account is consuming an excessive amount of system resources, Vivihosting.com may opt to temporarily deactivate the concerned account. If deemed necessary by Vivihosting.com staff, the customer of the account in question may receive an eviction notice, allowing them a period of seven (7) days to either upgrade their hosting plan or explore an alternative hosting solution recommended by Vivihosting.com staff. Vivihosting.com retains the exclusive authority to determine what qualifies as a breach of this provision. Given the distinctive nature of this provision, each account will be evaluated and assessed on an individual basis.

Backups

Vivihosting.com conducts nightly backups of Shared Hosting and WordPress hosting accounts primarily for internal administrative use. It’s important to note that these backups are NOT GUARANTEED in any way! Customers are urged to take responsibility for maintaining their own backups on their personal computers. In the event of backup failures, Vivihosting.com does not offer compensation for lost or incomplete data. While we strive to achieve comprehensive and accurate backups, we assume no responsibility for this task. It is essential to regularly back up your site on your personal computer. We do not provide any assurances regarding backup availability.

Your hosting account is not to be utilized as a backup solution. Our Services are specifically intended for hosting your website and should not be employed as a data storage facility. Vivihosting.com maintains the authority to delete backups from your hosting account, with or without prior notice.

We reserve the right to remove the following types of files, particularly if they are consuming excessive disk space and impacting other customers: (i) Local backups generated through Plesk panel or other methods, (ii) Locally stored backups created with Softaculous, (iii) Temporary files associated with Softaculous backups, (iv) Locally stored backups of common CMS platforms, (v) Temporary files associated with common CMS backups, (vi) Logs related to common CMS backups, (vii) Excessively large error logs, and (viii) Any other large files that are considered unnecessary for the fundamental functionality of websites or lack valuable data. Plesk panel-generated backups stored on the server will be automatically deleted after a period of fourteen (14) days.

Spam

Sending unsolicited email, commonly known as SPAM, from a Vivihosting.com server or using a return email address associated with a Vivihosting.com server is STRICTLY prohibited. Additionally, the use of SPAM to promote a website hosted on the Vivihosting.com network is considered a breach of this provision. The determination of whether a violation of this provision has occurred rests solely with Vivihosting.com. Websites discovered to be in violation of our SPAM policies will be promptly deactivated.

Cancellations

Account cancellations are handled by our Billing department. To cancel your account, please submit a cancellation request through the client area. Upon receiving your cancellation request, our Billing department will verify your request and proceed with the cancellation shortly thereafter.

Payments

You explicitly acknowledge, consent, and grant us the authority to automatically invoice the relevant fee and charge your credit card or other stored payment methods for each Renewal Term, unless you terminate or cancel the Services before such charge, as stipulated in this section. Vivihosting.com reserves the right to change prices or any other charges at any time.

Refunds

Customers are entitled to a refund of the payment made for web hosting services within a period of 14 calendar days from the initial payment for the hosting package, and there is no requirement to provide reasons for the request. Customers wishing to request a refund for hosting services must do so by submitting an unequivocal statement via email to contact@Vivihosting.com or through the integrated support system. This request should include the customer’s identification information, confirmation that all server data has been backed up, optionally, the reasons for requesting the refund, and any necessary information for the refund process.

Migrations

Our Migrations Team is dedicated to assisting you in the transfer of your website(s) to our platform. Please note that migrations are offered as a courtesy service. We cannot guarantee the availability, feasibility, or time required for completing an account migration. Different hosting companies have distinct configurations, and some hosting platforms store data in formats that may be incompatible or proprietary, potentially making it very challenging, if not impossible, to migrate certain or all account data. There might be instances where we are unable to aid in the data transfer from your previous host. The free migration service is accessible for a period of thirty (30) days from your signup date.

Noncompliance with policies

Failure to fully adhere to these terms may result in the suspension or deactivation of your account. All accounts and servers within the Vivihosting.com network are required to conform to the aforementioned policies. Vivihosting.com maintains the authority to deactivate and eliminate any website hosted on our servers if it contains content that, at its sole discretion, is considered unacceptable, undesirable, or contraindicated.
